Romanian CNA Decision 116/2026: who must notify, and by when
Ten cumulative conditions, not a follower threshold.
Romanian CNA Decision no. 116/2026 was published in the Official Gazette on 28 August 2026 and comes into force on 27 September 2026. For the first time, some channels on video platforms are treated as on-demand audiovisual media services and have to notify the National Audiovisual Council.
The notification deadline is 60 days from entry into force.
Who it actually covers
This is the part almost everyone gets wrong. The headlines stopped at “influencers with more than 100,000 followers”. The decision says something else: there are ten conditions, required together, and the CNA states explicitly that the follower count, taken on its own, produces no legal effect.
Five come from article 33 and define what an on-demand audiovisual media service is:
- the activity is commercial;
- you have editorial responsibility over the selection and ordering of content;
- the public can access the content on individual request;
- the main objective is information, entertainment or education;
- distribution happens through a video-sharing platform.
Another five come from article 36:
- the channel is accessible to the public in Romania;
- it addresses the public in Romania or the diaspora;
- it has at least 100,000 followers, added up across all platforms;
- you uploaded at least 24 audiovisual pieces in the last 12 months;
- there is monetisation — money, products, services or other benefits.
Miss one and the notification obligation does not exist. A creator with 300,000 followers who monetises nothing is not covered. One with 120,000 followers who uploaded ten videos last year is not covered.
What notification means
Notification is not content approval. The CNA does not review your material and does not give or withhold permission to publish. You register, that is all.
It is filed using the standard form in Annex 5 to the decision and asks for: details about the creator or the entity, the platforms and the channel, the estimated follower count, the monetisation methods, the platform’s jurisdiction and the subject matter.
